Taking a Urine Sample

This guy clearly did something to piss off the cop.

An Indiana man has filed a lawsuit claiming that police forcibly withdrew urine from his body during a drunken driving arrest.

According to the suit, police pulled over Jamie Lockard, 53, on suspicion of drunk driving in March. Police said he had driven through two stop signs.

A Breathalyzer test showed Lockard was under the legal limit, but Officer Brian Miller doubted the findings.

Lockard and his attorney claimed in the suit that police took him to Dearborn County Hospital and forced him to submit to a urine test.

Police said they obtained a warrant to obtain a blood and urine sample. They said Lockard refused to provide either voluntarily, saying he could not urinate and declining to drinks fluids to help him urinate.

Lockard's attorney said his client was shackled to a gurney and had a catheter inserted against his will.

What kind of judge signed that warrant?

Lynn Spears is the woman in Vancouver who was arrested for DWI after her 8 year old son called 911 to say he was in the car with his mother and she was driving drunk.

The 911 tape is all over TV and the talking heads are demonizing the mother, telling us how important it is for society to protect the children.

The thing that bothers me the most about it is something that nobody seems to want to talk about. What kind of society encourages 8 year old kids to inform on their parents?

Another cop gets a pass

A cop in Alabama drove his squad car to NY to go to a K9 school, taking his dog with him.

While in NY, driving his police car, he get arrested for DWI and leaving the scence of an accident.

NY allowed him to plead it down to a failure to control the vehicle, dismissed the leaving the scene charge and he paid a fine.

In Alabama DWI's are not allowed to plead down.

He's still a cop in Alabama.

The level of insanity is just stunning

I just saw a promo for a new segment that an OKC TV station will show Monday.

Steps to take to ensure that when you're house shopping you don't end up with a house that has been used as a meth lab.

That's right. That's high on the list of things you should worry about when buying a new house.

When I was living in Houston a few years back the DEA had an entrapment program where they set people up to run meth labs in downtown hotel rooms. That's okay, no danger to anyone. (It was when the head of the local DEA was tranferred after his 3rd DWI arrest). But be careful with those houses in the suburbs.

Lock 'em all up

We have more and more people in the US that loudly call for building more and more prisons to lock up people who violate the law in a way that reminds of them of some personal loss of their own. One of the biggest groups that do this is MADD, with aggressive arguments in favor of locking up more and more people for less and less of an offense.

Not only have we lowered the BAC level that triggers presumption of inability to control a vehicle from 10% BAC to 8% BAC, in some cases the 8% isn't just presumptive, it's illegal on it's own, even if you have perfectly acceptable control of the vehicle and can proof it. The US has really gone nuts about this.

So, as much as I dislike anyone being hurt, I can't help but have mixed feelings about this story

An advocate for tougher sentences for drunken drivers was struck and killed late Wednesday by a hit-and-run driver as she was walked along Interstate 70 in South Huntingdon Township.

Zona said that Tomajko was walking eastbound along the highway and then crossed into the westbound lanes by hopping over the concrete median.

"Once in the westbound lane, the victim was struck by an unknown vehicle ... then struck by several other vehicles," he said.

Maybe she was drunk.

Or maybe we need longer prison sentences for jaywalkers.
